Introduction: Moxie Chic (i.e., Moxified Designs, LLC) is (“Sponsor”) is offering an online contest (“Contest”) in honor of International Day of the Girl #IDG2020 #DayoftheGirl2020, a day chosen by the United Nations to celebrate female empowerment and in particular, adolescent girls who are viewed as powerful change-makers. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
Eligibility: Entrant must be between the ages of five (5) and sixteen (16) as of Sunday, October 11, 2020 in order to participate. A completed minor waiver signed by both the Entrant and a parent/legal guardian must be signed by potential winner. Entrant must be a legal resident of and reside in the fifty (50) United States or the District of Columbia.
Timing: Contest begins at 12:00:01 am E.T. on Sunday, October 11, 2020 and ends at 11:59:59 pm on E.T. on Wednesday, November 11, 2020.
How to Enter: Create an original design (drawing and/or words) embodying “what feminism means to me” reflecting that girls have a bright future, one where they are free to dream, create and learn (“Design”). Design must align with Sponsor’s mission of spreading “positive feminism”, meaning it should be inspirational, uplifting and empowering. No crude, derogatory, offensive or hurtful language or imagery may appear in the Design. Send Design to info@moxie-chic.com. Design file must be a .png, .jpg or .pdf file; Design may be a hand-drawn and converted to the acceptable file format. Multiple entries from the same person will be disqualified. By participating in the Contest, Entrant certifies that his/her entry is original, has not been previously published or won any award, and does not contain any material that would violate or infringe upon the rights of any third party, including copyrights, trademarks or rights or privacy or publicity. Judging Criteria/Winner Notificaiton: Each Entrant must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements. Winner will be selected based on originality and expression of authentic and unique point of view and style. All entries will be judged by Sponsor. Winners will be determined in the sole discretion of the Sponsor. All decisions are final. In the event Sponsor does not receive a sufficient number of eligible entries or there are not a sufficient number of acceptable entries in Sponsor’s sole discretion, the Sponsor has the right to cancel the Contest. Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that it believes does not comply with these Official Rules, including without limitation, contains obscene, offensive or inappropriate content or that is not consistent with the spirit or theme of the Contest and Sponsor’s “positive feminism” mission. The decision of the Sponsor is final and binding on all matters relating to the Contest. Potential winner wil be notified by email on or about November 15, 2020. If a potential winner cannot be contacted or does not respond with appropriate paperwork completed (see Section 7 below) within three (3) days after the first attempt to contact such potential winner, an alternate Entrant will be selected in his or her place from the entries received.
Prizes/Approximate Retail Value: Winner’s Design will be featured on www.moxie-chic.com (the “Website”) and on Moxie Chic’s/#VoiceYourMoxie social media channels. Design will be converted by Sponsor into proper graphic format to be printed on a t-shirt for sale on the Website, with 100% of the profits donated to Girls Inc. for a period of time determined by Sponsor in its sole discretion. The winner will receive no monetary compensation for winning the Contest and will receive no proceeds from the sale(s) of the shirts. Prize is non-transferable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor in the event that the prize cannot be awarded for any reason, in which case, Sponsor will substitute a prize of equal or greater value. All taxes, fees and surcharges on prizes are the sole responsibility of the winner.
Other Terms and Conditions: All entries must be original, may not have been won previous prizes and must not infringe on any third party rights. Submission of entry constitutes Entrant’s consent (and that of their parent/legal guardian given they are a minor in their state of residence) to irrevocably assign to Sponsor any and all rights to their entry including, but not limited to, intellectual property rights. Potential winner and his/her parent(s) or legal guardian (due to potential winner being a minor) will be required to sign and return an Affidavit of Eligibility (including Copyright Assignment, Publicity Release and Liability Release), within three (3) days of notification, failing which the potential winner will be disqualified and another winner selected in the place of the disqualified person from all entries received. If any prize notification is returned as non-deliverable, the potential winner will be disqualified and another potential winner will be selected in the original potential winner's place. By accepting the prize, the winner and her/his parent/legal guardian agree that the Sponsor and those acting under the Sponsor's authority, may use winner's name, picture/portrait likeness and/or voice, for advertising and promotional purposes without further consideration, unless prohibited by law. BY ACCEPTING THE PRIZE, THE WINNER AND WINNER’S PARENT/LEGAL GUARDIAN AGREE THAT THE SPONSOR, ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY.
Miscellaneous. All entries become the sole property of Sponsor(s) and none will be acknowledged or returned. In the event of a dispute, entries made by the Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry or the minor domiciled with such account holder. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner (or his/her parent/legal guardian) is the authorized account holder of the e-mail address associated with the winning entry. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction causing a failure of any e-mail or entry to be received by Sponsor. Sponsor is not responsible for late, lost, illegible, incomplete, or misdirected (i) entries or (ii) winner notifications. In the event that the operation, security or administration of the Contest is impaired in any way, for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human interventions or other technical problem, or in the event the Contest is unable to run as planned for any reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (i) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to teh spirit of these Official Rules or (ii) terminate the Contest and, in the event of termination, award the prize from among the eligible, non-suspect entries received up to teh time of impairment. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR(S) RESERVE(S) THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
